Gardeners Wandsworth Service Terms and Conditions
These Terms and Conditions govern the provision of gardening and related services by Gardeners Wandsworth to residential and commercial customers. By booking or receiving any service from Gardeners Wandsworth, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below.
Customer means the person, company, or organisation requesting services from Gardeners Wandsworth.
Services means gardening services and any related work provided by Gardeners Wandsworth, including but not limited to lawn care, hedge trimming, planting, garden tidy-ups, routine maintenance, and green waste handling.
Agreement means the contract between Gardeners Wandsworth and the Customer, comprising these Terms and Conditions and any written confirmation or quotation accepted by the Customer.
Visit means each attendance by Gardeners Wandsworth at the Customer’s property for the provision of Services.
Property means the garden or outdoor area where the Services are to be provided.
2. Scope of Services
2.1 Gardeners Wandsworth provides professional gardening and outdoor maintenance services within its defined service area. The exact scope of work for each Visit will be set out in a quotation, service description, or booking confirmation.
2.2 The Services may include one-off jobs or regular maintenance visits. The type, frequency, and duration of each Service are agreed with the Customer at the time of booking.
2.3 Any tasks not expressly included in the quotation or booking confirmation are deemed excluded and will only be carried out if agreed separately in writing, which may involve additional charges.
2.4 Gardeners Wandsworth reserves the right to decline work that is unsafe, unlawful, or beyond the reasonable skill or capacity of the team, including work at height without suitable access, or work requiring specialist qualifications not held by the company.
3. Booking Process
3.1 Bookings can be requested by the Customer via the available contact methods published by Gardeners Wandsworth. All bookings are subject to availability and confirmation.
3.2 When requesting a booking, the Customer must provide accurate information about the Property, access, parking, and the nature and size of the work required. Any omission or inaccuracy may result in additional charges, changes to the quoted price, or cancellation of the Visit.
3.3 Gardeners Wandsworth will provide a quotation or estimated price based on the information supplied by the Customer and, where necessary, a site visit. The quotation may be a fixed price or an hourly rate with an estimated duration.
3.4 An Agreement is formed when the Customer accepts the quotation or booking confirmation, whether in writing or verbally, and a date and time window for the Visit is agreed.
3.5 For regular maintenance contracts, the Agreement will specify the approximate schedule of Visits. While Gardeners Wandsworth will use reasonable endeavours to attend on the agreed dates, all dates and times are estimates and may be subject to change due to weather conditions, operational reasons, or other circumstances beyond the company’s control.
4. Access and Customer Responsibilities
4.1 The Customer is responsible for ensuring that Gardeners Wandsworth has safe and reasonable access to the Property at the agreed time. This includes providing necessary keys, access codes, or arranging for someone to be present to grant entry.
4.2 If access is not available at the agreed time, or if the team is unable to commence work due to issues within the Customer’s control, Gardeners Wandsworth may charge a call-out or missed appointment fee to cover time and travel costs.
4.3 The Customer must ensure that the Property is reasonably clear of obstructions, animal waste, and hazards before the Visit. Gardeners Wandsworth may refuse to carry out all or part of the Services if conditions are unsafe or unsanitary, and a charge may still apply.
4.4 The Customer is responsible for informing Gardeners Wandsworth in advance of any underground cables, pipes, irrigation systems, or other hidden services that may be affected by gardening work. Gardeners Wandsworth will not be liable for damage to concealed services that have not been properly identified by the Customer.
4.5 The Customer must ensure that children and pets are kept away from work areas during the Visit for safety reasons.
5. Pricing, Estimates, and Quotations
5.1 Prices for the Services are based on the description of work, the size and condition of the garden, access, parking, and any other relevant factors.
5.2 Where a fixed-price quotation is provided, it will be valid for a specified period. After that period, Gardeners Wandsworth may revise the quotation.
5.3 Where Services are charged by the hour, the final charge will be based on the actual time spent on site, rounded to the nearest agreed unit of time, subject to any minimum charge that may apply.
5.4 If, upon arrival, the actual scope of work is significantly different from that described by the Customer when the quotation was given, Gardeners Wandsworth reserves the right to amend the price or decline the work.
5.5 Any additional materials, plants, or equipment hired specifically for the Customer’s job will be charged separately and will be agreed with the Customer as part of the quotation or as a variation.
6. Payments and Invoicing
6.1 Payment terms will be stated in the quotation or invoice. Unless otherwise agreed, payment is due on completion of the Visit or on receipt of the invoice.
6.2 Gardeners Wandsworth accepts the payment methods specified in its invoices or booking confirmations. Cash payments, where accepted, must be made directly to an authorised representative and a receipt requested at the time of payment.
6.3 For larger projects or where significant materials are required, Gardeners Wandsworth may require a deposit or advance payment. Work may not commence until the required sum has been received.
6.4 If payment is not made by the due date, Gardeners Wandsworth reserves the right to charge interest on the overdue amount and to suspend or cancel further Services until full payment is received.
6.5 The Customer is responsible for all bank charges or transaction fees associated with international or special method payments, where applicable.
7. Cancellations, Rescheduling, and Delays
7.1 The Customer may cancel or request to reschedule a Visit by giving reasonable notice. The minimum notice period for cancellation or rescheduling will be stated at the time of booking.
7.2 If the Customer cancels or reschedules with less notice than the minimum period, Gardeners Wandsworth may charge a cancellation or late-change fee to cover costs and lost time.
7.3 Gardeners Wandsworth reserves the right to cancel or reschedule a Visit in the event of severe weather, staff illness, vehicle breakdown, safety concerns, or other circumstances beyond its reasonable control. In such cases, the company will offer an alternative date as soon as reasonably practicable.
7.4 Gardeners Wandsworth is not liable for any loss, damage, or expense incurred by the Customer as a result of a cancellation or delay, provided that reasonable efforts are made to reschedule and to keep the Customer informed.
8. Quality of Service and Complaints
8.1 Gardeners Wandsworth aims to carry out the Services with reasonable skill and care, in accordance with accepted industry standards for gardening work.
8.2 If the Customer is dissatisfied with any aspect of the Services, they should notify Gardeners Wandsworth as soon as possible, preferably within 48 hours of the Visit. The company will investigate and, where appropriate, take reasonable steps to address the issue.
8.3 The Customer must allow Gardeners Wandsworth the opportunity to inspect and, if necessary, rectify any alleged defect in the Services before arranging third-party corrective work. Gardeners Wandsworth will not be liable for costs incurred by the Customer in such cases where no opportunity to rectify has been given.
9. Waste Handling and Environmental Regulations
9.1 Gardeners Wandsworth will handle green waste and garden debris arising from its work in accordance with applicable UK waste and environmental regulations.
9.2 The quotation or booking confirmation will specify whether the removal of green waste from the Property is included. If not included, the Customer is responsible for the disposal of any waste left on site.
9.3 Where waste removal is included or requested, additional charges may apply based on the volume, type of waste, and disposal fees. Only approved waste types will be removed; household rubbish, hazardous materials, soil contaminated with chemicals, or construction debris are not normally included.
9.4 Gardeners Wandsworth supports responsible gardening practices, including recycling and composting where possible. The Customer may request that green waste be left in a designated area for composting, provided it does not breach local regulations or create a nuisance.
10. Health and Safety
10.1 Gardeners Wandsworth will take reasonable steps to ensure the health and safety of its staff, the Customer, and members of the public while providing the Services.
10.2 The Customer agrees to co-operate with any reasonable health and safety requests, including restricting access to work areas and keeping pets and children away from machinery and tools.
10.3 Gardeners Wandsworth may suspend work if it considers that continuing would pose a risk to health, safety, or property. In such circumstances, the Customer may still be liable for charges incurred up to the time of suspension.
11. Property Damage and Liability
11.1 Gardeners Wandsworth will exercise reasonable care to avoid damage to the Customer’s property while providing the Services.
11.2 The Customer must notify Gardeners Wandsworth of any damage allegedly caused by its staff or subcontractors as soon as reasonably practicable, and in any event within a reasonable period after becoming aware of it.
11.3 To the fullest extent permitted by law, Gardeners Wandsworth’s total liability for loss or damage arising out of or in connection with the Services shall be limited to the total amount paid or payable by the Customer for the specific Visit during which the event giving rise to the claim occurred.
11.4 Gardeners Wandsworth will not be liable for any loss of profit, loss of enjoyment, loss of business, or any indirect or consequential loss arising from the provision of the Services.
11.5 Gardeners Wandsworth is not liable for death, disease, or damage affecting plants, lawns, or trees as a result of pre-existing conditions, pests, diseases, adverse weather, or incorrect maintenance by the Customer.
11.6 Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
12. Guarantees and Plant Survival
12.1 Where Gardeners Wandsworth supplies and plants shrubs, trees, or other plants, it will select stock from reputable suppliers. However, plant survival is dependent on many factors outside the company’s control, including weather, soil conditions, pests, and ongoing care.
12.2 Unless expressly stated in writing, Gardeners Wandsworth does not guarantee the survival or performance of plants after planting. Any specific warranties or care instructions provided must be followed by the Customer.
12.3 The Customer is responsible for ongoing watering, feeding, and maintenance of plants following completion of the Services unless a separate maintenance contract is agreed.
13. Insurance
13.1 Gardeners Wandsworth will maintain appropriate public liability insurance in connection with the Services.
13.2 Evidence of insurance cover can be made available to the Customer on reasonable request.
14. Data Protection and Privacy
14.1 Gardeners Wandsworth may collect and process personal information about the Customer for the purposes of providing the Services, managing the Agreement, and complying with legal obligations.
14.2 Personal data will be handled in accordance with applicable UK data protection legislation. Gardeners Wandsworth will take reasonable steps to keep personal data secure and will not share it with third parties except where necessary to perform the Services, process payments, or comply with legal requirements.
15. Variation of Terms
15.1 Gardeners Wandsworth may amend these Terms and Conditions from time to time. The version in force at the time of the Customer’s booking will apply to that particular Agreement.
15.2 Updated terms may be made available to Customers for future bookings, and continued use of the Services will constitute acceptance of the revised terms.
16. Governing Law and Jurisdiction
16.1 These Terms and Conditions and any non-contractual obligations arising out of or in connection with them are governed by and construed in accordance with the laws of England and Wales.
16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
17. Severability
17.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision will be deemed deleted, and the remaining provisions shall continue in full force and effect.
18. Entire Agreement
18.1 These Terms and Conditions, together with any quotation or booking confirmation, constitute the entire agreement between Gardeners Wandsworth and the Customer in relation to the Services and supersede any prior discussions, correspondence, or understandings.
18.2 No waiver of any right or remedy under these Terms and Conditions shall be effective unless given in writing, and any failure or delay to exercise any right or remedy shall not be deemed a waiver of that or any other right or remedy.
